LEGAL AND ETHICAL CONSIDERATIONS
Legal Issues:

Copyright

Copyright is the exclusive and assignable legal right, given to the originator for a fixed number of years, to print, publish, perform, film, or record literary, artistic, or musical material.
Copyright law and copyright originated in the UK from a concept of

Common law; the Statute of Anne 1709.
The duration of copyright varies according to the work involved.


Copyright is not an issue with regards to my work because it will be all my own work.




Discrimination

The unjust or prejudicial treatment of different categories of people, especially on the grounds of race, age, or sex.
It is against the law to discriminate against anyone because of:

-Age
-Being or becoming a transsexual person
-Being married or in a civil partnership
-Disability
-Race including color, nationality, ethnic or national origin
-Religion, belief or lack of religion/belief
-Sex
Before the Act came into force there were several pieces of legislation to cover discrimination, including:
-Sex Discrimination Act 1975
-Race Relations Act 1976
-Disability Discrimination Act 1995

Discrimination will not occur within my work because I have used both male and female genders and they will not being doing anything in which can harm other people or be offensive to people that may see it.

 


Obscenity

The state or quality of being obscene.
Law established by the Obscene Publications Act 1959 prohibiting the publishing of any material that tends to deprave or corrupt. In Britain, obscene material can be, for example, pornographic or violent, or can encourage drug taking.

There will be no obscenity within my photo-shoot as there will be no drug related pictures, no violent images, and no pornographic images in which I use. All my images will be planned and posed in a suitable manner for the target audience and also suitable for any audience member so there will be no-one offended by the content of the images.

 

 

Trespassing:
This is where you cannot go onto private land without permission.
this does not apply to my photo-shoot as I will be doing it outside of college in my back garden where I am not breaking any laws or trespassing, also I will be using PA.16 which I have permission to go in from college so I am not trespassing.

 

 

ETHICAL CONSIDERATIONS:
Ethics are
moral principles that govern a person's behaviour or the conducting of an activity

 

Pose
the poses used by the models will all be positive image on the front cover. As my magazine is a positive magazine and therefore the images and poses of the models will not be used or offend anyone. For example, my poses are all staged and thought out. All models will have a smile on their faces which shows the positivity about the magazine as a whole, to make hem want to see in the inside content of my magazine.


Dress-
The clothing chose for the models to be wearing for the photo-shoot will be appropriate for target audience and fit in the theme. They will be suitable clothes which will not offend any person who sees it and will be age appropriate for the models as they are the ages of 16/17.


Sexuality
I am using both male and female models so therefore am not being sexist as the magazine will therefore appeal to both the male and female population with both genders included in the magazine.

 

Race
The photo-shoot will take into consideration race, and therefore will not be aimed at just one race, but all races so there is no racism or any person feeling alienated from reading the magazine, will be readable for all races. On the front covers my models will be white. However, on the inside I will have a range of different raced models included on the inside pages of my magazine.
